IELTS Pulse - Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your access to and use of the IELTS Pulse mobile application, website, AI tools, and related services (collectively, the "Service").

The Service is developed by Finnove Technologies Pvt. Ltd. and operated and managed by Fueling Ambitions Pvt. Ltd. ("Company", "We", "Us", "Our"). For all contractual, commercial, and operational matters, Fueling Ambitions Pvt. Ltd. is the responsible entity.

By using the Service, you agree to these Terms. If you do not agree, you must discontinue use immediately.

2. Scope of Services

• AI-powered IELTS Speaking and Writing practice tools
• Mock tests, vocabulary tools, and learning materials
• A coin-based digital reward system
• Optional callback-based assistance to help users understand the IELTS test booking process
• Community features for discussion ("Pulse Community")

All features are provided solely for educational and practice purposes.

3. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and all activities under your account.

The Company may suspend or terminate accounts that violate these Terms or community rules.

4. Coins, Purchases & Rewards

IELTS Pulse uses a virtual coin system ("Coins") for unlocking premium features.

• Coins have no monetary value, are non-refundable, non-transferable, and cannot be exchanged for cash.
• Promotional or rewarded Coins are granted at the Company's discretion.
• Purchases of Coins or premium features are final and non-refundable, except where required by law.
• Misuse of the coin system may result in account termination.

5. AI Tools & Limitations

IELTS Pulse provides AI-based speaking and writing evaluation tools. These outputs are:

• Automatically generated
• For practice purposes only
• Not equivalent to official IELTS scoring
• Not guaranteed to be accurate or error-free

You acknowledge that AI suggestions may be imperfect and should be used only as guidance. The Company is not liable for decisions made based on AI outputs.

6. Test Booking Support (Non-Binding Assistance)

IELTS Pulse may provide optional callback-based assistance through selected partners. You acknowledge and agree that:

• IELTS Pulse is not an official IELTS test center
• No guarantee of dates, seats, or results
• Payments occur directly with authorized providers
• No responsibility for booking outcomes
• Booking-related rewards are issued only after verified completion

7. Pulse Community Rules

You agree not to share:

• Abusive, harmful, or discriminatory content
• Spam, advertising, or fraud
• Copyrighted content without permission
• Misleading claims or impersonation

The Company may remove content, hide violations, or permanently ban repeat offenders at its discretion.

8. Service Availability & Modifications

The Company does not guarantee uninterrupted or error-free access. The Service may be updated, modified, restricted, or discontinued at any time due to technical, legal, or business reasons. The Company is not liable for outages, data loss, or feature changes.

9. User Responsibilities

You agree not to:

• misuse the Service, attempt unauthorized access, or interfere with platform functionality,
• reverse-engineer or copy the AI systems,
• exploit promotions, coins, or referral systems,
• submit harmful or illegal content.

10. Intellectual Property

All app content, branding, AI systems, software, and materials are the exclusive property of the Company or its licensors. Users receive a limited, non-transferable license to use the Service. No ownership rights are transferred.

11. Third-Party Services

The Service integrates third-party tools such as payment gateways, analytics systems, and booking partners. The Company is not responsible for:

• the security or accuracy of third-party systems,
• failures caused by external integrations,
• actions taken by external service providers.

Use of third-party services is subject to their terms and policies.

12. Disclaimers

The Service is provided “as is” without warranties of any kind. The Company does not warrant that:

• the AI results will be accurate,
• the Service will be uninterrupted or error-free,
• your IELTS score will improve,
• bookings will be guaranteed.

You use the Service at your own risk.

13. Limitation of Liability

To the maximum extent permitted by law:

• The Company's total liability arising from the Service is limited to USD 100.
• The Company is not responsible for indirect, incidental, or consequential damages
• AI outputs, community posts, booking outcomes, or user decisions are solely the User's responsibility.

14. Indemnification

You agree to indemnify and hold harmless the Company, its officers, employees, developers, and affiliates from any claims or damages arising from:

• misuse of the Service,
• violation of these Terms,
• content submitted by you,

actions taken during booking assistance.

15. Dispute Resolution & Class Action Waiver

To the extent permitted by law, disputes with the Company must be resolved individually. You waive any right to participate in a class action, class arbitration, or collective proceeding.

16. Governing Law

These Terms are governed by the laws of Nepal. Any disputes shall be resolved exclusively by the courts in Kathmandu.

17. Changes to These Terms

We may update or modify these Terms at any time. Continued use of the Service constitutes acceptance of updated Terms.
